State requirements for ATM fee disclosure

Even thought Congress just mandated that credit unions no longer have to display a physical sign for ATM fees since they are disclosed electronically, it's just a federal law and not covered by states. The good news in Alabama and Florida is that the new federal law also covers state law.

In Alabama, state law requires credit unions to either disclose fees through a physical sign or electronically. The new law covers this requirement. In Florida, credit unions simply have to follow the guidelines set forth by Reg. E. This new law covers this, as well.

On Dec. 28, President Obama signed H.R. 4367 into law. This legislation limits the number of ATM fee disclosures for financial institutions. Since the fees are disclosed electronically, it was redundant, plus some people were taking the physical signs down and then attempting to sue financial institutions for failure to display ATM fees.
